Terms and Conditions of Carriage
1. Definitions
In these conditions, the following terms shall have the following meanings:
- "Carrier" means Vintage Express.
- "Consignor" means the person who contracts with the Carrier for the carriage of goods.
- "Consignee" means the person to whom the goods are to be delivered.
- "Goods" means any articles or things of whatsoever nature that the Carrier has agreed to carry.
- "Contract" means the agreement between the Carrier and the Consignor for the carriage of goods.
2. Application of Conditions
These conditions shall apply to all contracts for the carriage of goods entered into by the Carrier, unless otherwise agreed in writing by the Carrier.
3. Carrier's Responsibility
The Carrier shall be responsible for the goods while they are in its possession, and until they are delivered to the Consignee. The Carrier's responsibility shall be limited to the amount specified in the Carrier's liability insurance, unless otherwise agreed in writing.
4. Consignor's Responsibility
The Consignor shall be responsible for ensuring that the goods are properly packed and labeled for transport. The Consignor shall also provide the Carrier with all necessary information regarding the goods, including but not limited to, the nature of the goods, their value, and any special handling requirements.
5. Delivery
The Carrier shall make every reasonable effort to deliver the goods by the agreed delivery date. However, the Carrier shall not be liable for any delay in delivery caused by circumstances beyond its control, including but not limited to, acts of God, war, strikes, or governmental restrictions.
6. Liability
The Carrier's liability for loss or damage to the goods shall be limited to the amount specified in the Carrier's liability insurance. The Carrier shall not be liable for any indirect or consequential loss or damage, including but not limited to, loss of profit, loss of market, or loss of reputation.
7. Claims
Any claims for loss or damage to the goods must be made in writing within 7 days of delivery. The Carrier shall have the right to inspect the goods before any claim is settled.
8. Governing Law
These conditions shall be governed by and construed in accordance with the laws of Poland. Any disputes arising under or in connection with these conditions shall be subject to the exclusive jurisdiction of the Polish courts.
9. General
If any provision of these conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The Carrier's failure to enforce any provision of these conditions shall not be deemed a waiver of such provision.
